IRS Guidelines for Film & Video Industry Contractors

I just came across a very useful document for both freelancers or any Executive or Supervising Producers or the like. It defines what the critical distinctions are in determining the difference between independent contractors and employees.

In a time when many companies are busy trying to replace full-time employees with freelance or “perma-lance” positions, this gives the IRS perspective on what’s what. It is really important for ProdCo’s to be able to quickly scale up and down on a project basis, but at the same time, no one wants to be the target of an IRS audit, a wrongful termination lawsuit or the penalties that either might entail.

The entire linked  page covers this topic well for film/video/television, but this link goes right to the “critical” and “significant factors” that are most important to the IRS.
